Introduction

These Terms of Service ("Terms") govern your use of the PhotoID mobile application ("App") operated by PhotoID ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you disagree with any part of these terms, do not use the App.

App Description

PhotoID is a mobile application that helps users create passport, visa, and ID photos that comply with official requirements for 150+ countries. Users select their country and document type, take a photo or choose from gallery, and AI technology analyzes and formats the photo for compliance with official standards.

Important: Photos are processed using AI technology through OpenAI's secure servers. According to OpenAI's data retention policy, photos are stored on their servers for up to 30 days before being automatically deleted.

License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

Acceptable Use

You agree to use the App only for lawful purposes. You must not:

  • Use the App to create fraudulent identification documents
  • Process photos of other people without their consent
  • Attempt to reverse engineer or hack the App
  • Use the App for any commercial purpose without authorization
  • Violate any applicable laws or regulations
  • Interfere with the App's functionality

Photo Processing

AI-Powered Processing

Photo processing is performed using OpenAI's AI technology. Your photos are sent to OpenAI's secure servers for analysis and compliance checking. According to OpenAI's data retention policy, these photos are stored on their servers for up to 30 days before being automatically deleted.

Accuracy

While we strive for accuracy, we cannot guarantee that processed photos will be accepted by all authorities. You are responsible for verifying compliance with specific requirements.

Photo quality depends on the input image quality and device capabilities. We recommend using high-resolution photos for best results.

Third-Party Services

OpenAI

PhotoID uses OpenAI's API for photo analysis and processing. By using this app, you acknowledge that your photos will be temporarily processed by OpenAI's systems in accordance with OpenAI's Terms of Use and Privacy Policy. OpenAI's services are subject to their own terms and conditions.

Service Availability

The app's functionality depends on the availability of OpenAI's services. We cannot guarantee uninterrupted service and are not responsible for any downtime or service interruptions caused by third-party providers.

User Responsibilities

You are responsible for:

  • Ensuring your device meets the App's system requirements
  • Maintaining the security of your device
  • Verifying that processed photos meet your specific requirements
  • Complying with all applicable laws when using the App
  • Using the App only with photos you have the right to process

Subscriptions and Billing

Subscription Plans

PhotoID offers weekly and annual subscription plans. You can use the app to preview and process photos up to the download stage before subscribing. A subscription is required to download processed photos.

App Store Billing

All subscriptions are processed through the Apple App Store and are subject to Apple's Terms of Service. Payment will be charged to your iTunes Account at confirmation of purchase.

Auto-Renewal

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Managing Subscriptions

You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase. Cancellation will take effect at the end of the current billing period.

Refund Policy

Refunds are handled by Apple according to their standard policy. We offer a 15-day satisfaction guarantee - contact us for assistance with refund requests within 15 days of purchase.

Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy of photo processing results
  • Acceptance of processed photos by authorities
  • Uninterrupted or error-free operation

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Rejection of processed photos by authorities
  • Travel delays or missed appointments
  • Loss of data or photos
  • Business interruption

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms.

You may terminate your use of the App at any time by deleting it from your device.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where our company is registered, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App or by other reasonable means. Continued use of the App after changes constitutes acceptance of the new Terms.
